秘书之家—全网资源每日更新www.mishuzj.com建筑装饰工程施工合同Contract发包方（简称甲方）PartyA:承包方（简称乙方）：上海巧点装饰设计有限公司PartyB:i-pointdesign(InspirationPointDesign)根据<中华人民共和国合同法><中华人民共和国消费者权益保护法><中华人民共和国价格法><上海市合同格式条款监督条例>,<上海市建筑市场管理条例>,以及其他有关法律法规规定的原则，结合本工程的具体情况，甲、乙双方在平等、自愿、协商一致的基础上达成如下协议，共同遵守Accordingto:“PRCContractLaw”,“LawontheProtectionofConsumerInterests”,“PRCPriceLaw”,“ShanghaiSupervisionofContractTerms”,“ShanghaiConstructionMarketManagementRegulations”,aswellasotherlawsandregulationsrelevanttothespecificcircumstancesofthisproject,partiesAandBhaveherebyequallyandvoluntarilyenteredintothefollowingagreementexecutedonthebasisofmutualrespect.一、概况OVERVIEW1.甲方装饰物业系合法物业PartyAistheowneroftheproperty.2.乙方为本市经工商行政管理机关核准登记，并可从事装潢装修的企业PartyBisapprovedandregisteredwiththecityindustrialandcommercialadministrativeorgansasanenterpriseengagedinrenovationanddecoration.3.装饰施工地点Constructionsite:4.建筑结构：建筑面积平方米，施工面积平方米。m2,privatelivingarea:m2.Constructionarea:totalarea(includingstairwellsandothercommonareas):5.装饰施工内容：住宅装饰,详见附件一<工程估价单>Structure:residential.6.承包方式:详见附件一<工程估价单>Contractorengagementmethod:Seeannex–(quotation).7.总价款：.00元，大写(人民币):元整。Totalprice:.00RMB;inwords:元整.Anychangesinthispricemustbeagreedbybothpartiesinwriting.8.工期:自年月日开工，至年月日前竣工,工时总计天，不含国家法定节假日,乙方委派现场施工监理为先生，联系方式:Period:Start:(year)(month)(day);Completionbefore:(year)(month)(day);Totaldays(excludingnationalholidays):days.PartyB'sonsiteconstructionsupervisorwillbe:二、关于工程付款及结算的约定TERMSOFPAYMENT1.工程款的付款方式如下Thepaymentscheduleshallbeasfollows:付款时间付款时间Amount(RMB)TimingofPaymentsDate(yyyy.mm.dd)合同签订后60%Afterthecontractissigned.油漆工进场前30%Whenhalfoftheprojectperiodtimehaselapsed.家具、灯具进场前5%Furnitureoflampsandlanterns,beforetheapproach验收合格后,五天内5%UponAcceptanceofthecompletionoftheproject.增加工程项目100%签订工程项目变更单100%Projectchanges.Dateofsigningfortheprojectchange.空调工程项目100%Airconditioningproject家具工程项目100%秘书之家—全网资源每日更新www.mishuzj.comFurnitureengineering三、关于材料供应的约定AGREEMENTONTHESUPPLYOFMATERIALS1.乙方提供的材料：乙方供应的材料、设备,如不符合设计、施工要求，应禁止使用。如已使用，对工程造成的损失由乙方负责。如甲方要另增加材料由甲方供应，并应符合下列规定：MaterialprovidedbyPartyB:AnymaterialsorequipmentsuppliedbyPartyBwhichdonotmeetthedesignandconstructionrequirementsareprohibited.AnyextramaterialsrequestedbyPartyAwhichwerenotintheoriginaldesignmustbepaidforbyPartyA.2.甲方提供的材料：另拟补充附件<甲方提供材料、设备表>甲方负责采购供应的材料、设备，应符合设计施工要求的合格产品，并应按时供应到现场。乙方发现甲方提供的材料、设备有质量问题或规格差异，应及时向甲方提出，甲方仍要求使用的，由此造成工程损失，责任由甲方承担。甲方供应的材料按时抵达现场后，由乙方负责保管MaterialprovidedbyPartyA:(seetheannex:“TableofMaterialstobeprovidedbytheOwner”).IfPartyAacquiresmaterialsfortheproject,itshouldfirstcheckwithPartyBthatthematerialsmatchtothedesignrequirements,andoncethematerialsareinthecareofPartyB,thenPartyBisresponsibleforthematerials.IfPartyArequiressomematerialswhichdonotfittothedesignthenitshallbetheresponsibilityofPartyAtopayanyadditionalcostsincurredbyPartyB.四、关于工程质量及验收的约定FULFILMENTOFTHISAGREEMENT1.本工程应符合<建筑装饰工程技术规程>和市建设行政主管部门制定的其它地方标准\质量评定验收标准Theexecutionofthisprojectmustbeconsistentwiththe“ArchitecturalandEngineeringRules”ofthecityadministrativedepartmentsresponsibleforthedevelopmentofbuildingsandlocalstandardsandqualityevaluationacceptancecriteria.2.本工程由乙方进行设计，提供施工图纸一式两份，双方签字确认PartyBmustprovideaduplicatecopyoftheconstructiondesignsanddrawings,andbothcopiesshouldbesignedbybothparties.3.甲方提供的材料、设备质量不合格而影响工程质量，其返工费用由甲方承担，工期相应顺延IfmaterialsprovidedbyPartyAfortheconstructiondonotmeetthenecessaryrequirements,PartyAshallbearresponsibilityforanyresultingdelaysinthecompletionintheproject.4.由于乙方原因造成质量事故，其返工费用由乙方承担IfthequalityofPartyB'sworkresultsinanyaccidents,theliabilityforsuchaccidentsshallbetheresponsibilityofPartyB.5.在施工过程中，甲方提出设计修改意见及增减工程项目，须提前与乙方联系，在双方签订<工程项目变更单>后，方能进行该项目的施工、因此影响工程竣工日期的，责任由甲方承担。凡甲方私自与施工人员商定更改施工内容、增加施工项目所引起的一切后果，甲方自负，给乙方造成损失的，甲方应予赔偿If,duringtheconstruction,PartyAwishestoproposeachangetothedesign,heshouldsigna“ChangeofProject”withPartyBandmustassumeresponsibilityforresultingdelaysorincreaseincosts.IfPartyAsecretlyattemptstochangetodesigndirectlywiththeconstructionpersonnelandthisactioncauseslosstoPartyB,thenPartyAmustcompensatePartyBforthisloss.6.工程验收：乙方负责理隐蔽工程和中间工程的检查与验收手续。由乙方组织专门人员进行验收。一切理隐蔽工程和中间工程的质量由乙方负责Thestandardofwork.ItistheresponsibilityofPartyBtomakesurethatallconstructionworksarecarriedouttotherequirementsofthedesignandtomakesurethatallinternalwallsandhiddenconstructionpartsaretotherequiredstandard.7.工程竣工：乙方完工后即应通知甲方验收，甲方应在竣工当日组织验收，并办理验收移交手续，双方签<工程质量验收单>。如果甲方在规定时间内不能组织验收，须及时通知乙方，另定验收日期。如通过竣工验收，甲方应承认原竣工日期，并承担因此造成的乙方的看管费用和其他相关费用Projectcompletion.PartyBmustnotifyPartyAwhentheprojectiscompleteandreadyforinspectionbyPartyA.Afterinspectionbothpartiesmustsignan“EngineeringQualityAcceptance”document.IfPartyAisnotavailabletoinspecttheconstructionsiteonthecompletiondate,hemustnotifyPartyBofthesoonestavailabledate.WherePartyAisnotavailableonthecompletiondatetoretakecustodyofthelocation,hemustpayanyextracostsincurredbyPartyB.8.工程保修期一年。工程竣工验收后甲、乙双方签署<工程保修单>，凭保修单实行保修，保修期一年，从竣工验收签章之日起算Oneyearwarranty.Aftercompletionoftheworkandsigningofthe“SingleWarranty”,thereshallbeaoneyearwarrantyontheconstruction.五、有关安全生产和防火的约定SAFEPRODUCTIONANDFIREREGULATIONS1.施工图纸和施工说明应符合防火防事故的要求，主要包括电气线路等管道畅通、合格。乙方在施工中应采取必要的安全防护和消防措施，保障作业人员及相邻关系的安全,防止相邻单位的管道堵塞、渗漏水、停电、物品毁坏等事故发生Constructiondrawingsandconstructionmustbeinlinewithfirepreventionregulations,andaccidentpreventionrequirements.Thisincludeselectricalcircuitsandpipelines.PartyBshalltakemeasurestoensurethesafetyofworkersandneighborsattheconstructionssiteandmustpreventleakageofwater,interruptionsofpowerand秘书之家—全网资源每日更新www.mishuzj.comdamagetoproperty.2.施工中凡涉及改变房屋结构，拆、改承重墙，加大楼（地）面荷载，由甲方向物业管理部门提出申请，经所在地建设行政主管部门批准后方能施工Anychangestothehousingstructureordemolitionoralterationtoloadbearingwallsorincreaseinfloorloadmustfirstbeapprovedbythebuildingpropertymanagementbeforeconstructionbegins.3.双方款项往来均应出具正规收据和发票，以备查验和结算Bothpartiesmustprovidemoneyexchangereceiptsandinvoices.六、其它事项OTHERMATTERS1.甲方工作PartyA1.甲方应在开工前确认施工图纸并腾出足够的施工空间，以清除影响施工的障碍物。甲方向乙方提供施工需用的水、电等必备条件，并说明使用注意事项WhenPartyAconfirmsthepre-constructionandconstructiondrawings,hemustalsomakesurethereissufficientspaceavailableattheconstructionsiteforconstructiontotakeplace.PartyAmustmakesurethatPartyBhaseverythingnecessaryonsiteforcompletionoftheconstruction,particularlyelectricityandwater.2.做好施工中因临时使用公用部位操作影响邻里关系等的协调工作PartyAmusttakecareofthepublicrelationsintheconstructionsitearea–particularlywiththeneighbors.2.乙方工作PartyB1.参加甲方召集的现场交底PartyBmustbeavailabletoattendmeetingsorganizedbyPartyA.2.乙方按要求组织施工，保质、保量、按期完成施工任务PartyBmustfollowtheconstructionplans,andtheconstructionmustbedurable,andmustmeetthescheduledcompletiondate.七、违约责任LIABILITYFORBREACHOFCONTRACT1.由于甲方原因导致延期开工或中途停工，工期顺延IfPartyAcausesanydelaystothecompletionofthisproject,thenthescheduledcompletiondateshouldbeadjustedaccordingly.2.由于乙方原因逾期竣工的，每逾期一天，乙方向甲方支付工程造价0.1‰(大写:千分之一)的违约金IfPartyBcausesanydelaytothecompletionofthisproject,thenPartyBmustpaytoPartyAafeeof0.1‰(inwords:1/1000)ofthetotaloverallprojectfeeforeachdaybeyondthescheduledcompletiondate.3.甲方未办理有关手续，强行要求乙方拆改原有建筑承重结构及共用设备管线，由此发生的损失或事故（包括罚款）由甲方负责并承担责任IfPartyAinstructsPartyBtomakeanyalterationstoaloadbearingwallandPartyAhasnotsoughtandreceivedpermissionfromthebuildingpropertymanagement,PartyAshallberesponsibleforanyresultingcostsandshallindemnifyPartyBforanyadditionalexpensesincurred.4.乙方擅自拆改原有建筑承重结构或共用设备管线，由此发生的损失或事故（包括罚款），由乙方负责并承担责任IfPartyBmakesanyunauthorizedchangestoloadbearingwallsorbuildingpipelinesandsuchchangesresultindamagesorloss,itshallbetheresponsibilityofPartyBtopayforsuchloss.5.工程未办理验收、结算手续，甲方提前使用或擅自动用工程成品由此造成无法验收和损失的,由甲方负责并承担责任PartyAshallberesponsibleforanyextracostsincurredduetohisuseofthepropertybeforethefinalcompletionmeetingandsigningofthe“EngineeringQualityAcceptance”document.八、纠纷处理方式DISPUTES1.因工程质量双方发生争议时，凭本合同文本向有关行业协会申请调解，也可向所在区、县建设行政主管部门或消费者协会投诉Ifthereisadisputebetweentheparties,thiscontractshouldbesubmittedtotherelevanttradeassociationformediationandalsotothehostdistrictandcountybuildingdepartmentsinchargeofadministrativecomplaints,ortoconsumerassociations.2.当事人不愿通过协商、调解解决、或协商、调解不成时，可以按照本合同约定向--上海仲裁委员会申请仲裁--人民法院提起诉讼if,afternegotiation,mediationand/orconsultation,thepartieshavefailedtoreachanagreement,thenthedisputeshouldbe:submittedtothe--ShanghaiArbitrationCommission--filedasalawsuit.九、合同变更和解除AMENDMENTANDTERMINATION1.合同经双方签字生效后，双方必须严格遵守。任何一方要求变更合同内容或解除合约，由双方协商解决，经双方签字确认后生效Afterthiscontractissigneditmustbestrictlyadheredto.Afterthecontractissigned,neitherpartycanleavethecontractwithoutagreementoftheotherparty.2.本合同签订后，工程不得转包秘书之家—全网资源每日更新www.mishuzj.comAfterthiscontractissigned,theprojectshallnotbesub-contracted.3.本合同一式两份，甲、乙双方各执1份，合同附件为本合同的组成部分，具有同等的法律效力Thiscontractwillbeprintedandsignedinduplicateandeachpartyshallkeepacopy.十、其它约定FINALCLAUSES1.如遇不可抗力因素，工期顺延Intheeventofforcemajeure,thiscontractwillbedelayedandresumeassoonaspracticablypossible.2.其他未在本合同内规定的事项双方协商解决Ifanymattersarisewhicharenotcoveredwithinthiscontract,theyshallbedealtwithbymutualconsultationbetweenthetwoparties.十一、附件ANNEX1.<工程估价单>Annex1.SingleWarranty2.办理施工进场手续费清单Annex2.ItemizedexpenditurelistofPartyBfortheconstruction(e.g.wasteremovalfeeschargedbythepropertymanagement).3.施工图纸或做法说明Annex3.Constructiondrawingsandpracticenotes.PartyA(Chop):PartyB(Chop):上海巧点装饰设计有限公司Corporation:CompanyOwner(name):廖娟英CompanyOwner(name):ProjectLeader:CompanyOwner(name):Address:ProjectLeader:王开锐PostCode:Address:姚虹路299弄12号1401Phone:PostCode:201103Fax:Phone:54775839Fax:54775608Date:年月日BankName:农行上海市长宁区古北新区支行AccountName:上海巧点装饰设计有限公司AccountNumber:033827-0004-0002751Date:年月日
